How General Surgeons contribute to medicolegal matters

Their role is to offer objective, clinically grounded insight that assists lawyers, insurers, regulators, and courts to understand surgical conditions, how procedures were planned and performed, how post-operative care was managed, and how outcomes or complications may relate to the issues in dispute.

Typically, medicolegal general surgeons provide:

  • File reviews involving medical records, operative notes, imaging, consent documentation, and post-operative care records
  • Expert advisory input on whether surgical assessment, decision-making, and operative management aligned with accepted standards of practice at the time
  • Opinion on diagnosis, surgical technique, intra-operative events, and management of complications
  • Independent Medical Examinations in matters where surgical injury, outcome, or ongoing impairment is central to the issues being considered
  • Impairment reporting where surgical procedures or complications have contributed to ongoing functional limitation
  • Supplementary reports to clarify or expand opinion as new information or questions arise
  • Expert witness work in civil claims, regulatory matters, or inquests, including participation in conferences, hearings, or court
  • Specialist surgical opinion in matters involving complex procedures, post-operative complications, or catastrophic injury
