How Psychiatrists contribute to medicolegal matters

Their role is to offer objective, clinically grounded insight that assists lawyers, insurers, regulators, and courts to understand mental health conditions, how psychiatric assessment and treatment were undertaken, how symptoms affect capacity and functioning, and how those factors may relate to the issues in dispute.

Typically, medicolegal psychiatrists provide:

  • File reviews involving medical records, psychiatric reports, treatment notes, and medication history
  • Expert advisory input on whether psychiatric assessment, diagnosis, and management aligned with accepted standards of practice at the time
  • Opinion on diagnosis, symptom severity, prognosis, and the impact of mental illness on capacity and decision-making
  • Independent Medical Examinations in matters where psychiatric condition or treatment outcome is central to the issues being considered
  • Impairment reporting where mental health conditions have contributed to ongoing functional limitation
  • Supplementary reports to clarify or expand opinion as new information or questions arise
  • Expert witness work in civil claims, regulatory matters, or inquests, including participation in conferences, hearings, or court
  • Specialist psychiatric opinion in matters involving complex mental health presentations, risk assessment, or catastrophic outcomes
